Terms of Use

These terms are the agreement between you and Hype & Swagger Ltd ("we", "us") for using Got Game. By creating an account, you accept them.

1. Who can use Got Game

You must be 18 or over. We check your date of birth at sign-up.
One account per person. Your phone number identifies you.
You are responsible for what happens on your account.

2. What Got Game is — and what it is not

We are a noticeboard, not an organiser. Got Game helps padel players find each other and agree to play. We do not run the games, we are not there, we do not vet venues, we do not check anybody's fitness, insurance or competence, and we do not supervise anything that happens.

Every game on Got Game is arranged between the people taking part. The host decides who plays, where and when. That is a private arrangement between them, and we are not a party to it.

Booking and paying for a court stays between you and the club. We do not take bookings, we do not handle payments, and we do not take a cut.

3. Padel carries risk, and you accept it

Playing sport can cause injury, including serious injury. Meeting people you do not know carries its own risks. You take part entirely at your own risk.

Before you play, it is on you to decide that you are fit enough, that the venue and the game suit you, and that you have whatever insurance you want. If something does not feel right, do not play.

4. How to behave

Do not:

Harass, threaten, bully or abuse anybody.
Post anything hateful, sexual, violent or illegal, including in photos and messages.
Pretend to be somebody else, or set up a club you have no connection to.
Create fake games, spam, or advertise.
Share anybody else's personal information, including photos of them, without their agreement.
Try to get round a block, a suspension or a deleted account.
Scrape, copy or automate the service.

Turn up, or say you are not coming. Not showing up without a word is the thing that ruins a game for the other three, and it is what your Attendance figure records.

5. Your level, your attendance, reports and blocks

Your level moves on recorded results, and where the number came from is always shown alongside it. Recording a result that did not happen, to move somebody's level or your own, is a breach of these terms.
Attendance counts finished games where a register was taken and you were on the roster. It is counted, not voted on — nobody scores you.
You can report a person, a game, a club or a message. Reports come to us, not to the person reported.
You can block anybody. Blocking is private to you and the other person is not told.
If somebody has blocked you, you cannot join a game they are in. The app will not tell you why, and that is deliberate: explaining it would give the block away.

6. Your content

What you post stays yours. You give us permission to store and display it inside Got Game so the app can work — showing your photo in a game's gallery to the people who were at that game, for example. That permission ends when you delete the content, except where somebody else's copy legitimately remains, such as a message you have already sent.

We can remove content that breaks these terms, and we can suspend or close an account that does.

7. Our liability

Got Game is provided as it is. We do not promise that it will be uninterrupted or error-free, or that anybody you meet through it will be who they say they are, turn up, or behave well.

To the fullest extent the law allows, we are not liable for injury, loss or damage arising from a game arranged through Got Game, from the conduct of another user, or from a venue.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, nothing here affects your statutory rights.

8. Ending it

You can delete your account at any time: Settings → Account settings → Delete account. It is hidden immediately and erased after 30 days, and you can stop it during those 30 days with the Keep my account button.
We can suspend or close your account if you break these terms, or if we need to protect somebody.

9. Changes, and the law that applies

If we change these terms in a way that materially affects you, we will tell you in the app before the change takes effect.

These terms, and any dispute arising out of them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
